Answer:No, as a supplier you must provide a remedy to the consumer, if they are considered a consumer for the purposes of the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth) and if you fail to comply with the Consumer Guarantees.
Consumers can seek a remedy from the supplier of a product for a breach of any of the Consumer Guarantees, which includes that the goods are of an acceptable quality and are reasonable for the purpose that the consumer has specified, subject to exceptions under s58 and s59 of the ACL (where manufacturers are required to provide remedies). As a supplier you can remedy the failure by repairing the goods, replacing the goods or providing a refund.
