Tips for Filing a Trade Mark Application in the UAE

The United Arab Emirates (UAE) is an international commercial hub, offering a prime opportunity for you to establish a unique market presence. If you are planning to conduct trade in the UAE, you should file a trade mark application to protect the identity of your brand and unlock new business opportunities. To ensure you apply for a trade mark lawfully, you must follow the specific guidelines set out by the Ministry of Economy. This article will outline the key processes involved in applying for and maintaining your trade mark in the UAE.

Understanding the Importance of Trade Marks

Trade marks are important to building a reputation with customers, shaping brand identity and distinguishing your goods and services from your competitors.  Particularly in the UAE, a region known for its thriving business landscape, a registered trade mark is a valuable asset that offers you legal protection. It grants you exclusive rights to prevent others from using identical or confusingly similar marks for alike products.

Conducting Thorough Research

You must conduct a comprehensive trade mark search to ensure that your mark is unique and available within the UAE market. This includes searching:

  • databases of registered trade marks;
  • pending applications; and
  • well-known unregistered trade marks.

This process will help you prevent legal disputes or your application being rejected.  To reduce any complications involved in the search process, you may consider engaging with a trade mark expert to assist you.

Engaging Professional Assistance

Trade mark registration laws differ from country to country. It is important that you make informed decisions and comply with regulations to ensure a successful registration. To navigate such complexity and streamline this process in the UAE, you should contact a professional who is knowledgeable about local trade mark laws. This may be a local trade mark attorney or an intellectual property (IP) firm that specialises in UAE law.

Preparing the Application

To prepare a trade mark application, you must gather all essential information required. You will need to compile several documents and provide them alongside your application, including:

  • the trade mark itself (word, logo, slogan, etc);
  • an incorporation certificate;
  • proof of your identity;
  • a power of attorney, which allows your lawyer or law firm to act on your behalf;
  • a description of the business;
  • a priority document (if applicable);
  • the goods and services claimed by the trade mark;
  • if registered in another country, the certificate of trade mark registration; and
  • a translation/transliteration of any words within the trade mark.

UAE trade mark laws stress that your trade mark must be both unique and inoffensive. A well-prepared application enhances your chances of approval and strengthens your brand’s legal standing in the market.

Submitting the Application

When filing a trade mark application through the UAE Ministry of Economy, you must follow a systematic procedure. To ensure your application is processed smoothly, you need to accurately complete the required forms and pay the necessary fees within the specified timelines.

Monitoring and Responding

After submitting a trade mark application, you should regularly monitor its status and promptly address any queries or objections raised by the trade mark office. Timely responses are necessary to avoid your application being potentially delayed or rejected. By being proactive, you demonstrate a commitment to the application process and improve your likelihood of successful registration.

Maintaining and Renewing the Trade Mark

Trade mark registration in the UAE is valid for 10 years. Importantly, registering a trade mark is an ongoing responsibility. When the 10-year period of trade mark registration ends, you have three months from the expiry date to renew the registration. However, if you delay the renewal, you will have to pay a fine of AED 1,000 for each month of delay.

To keep your trade mark valid and protected, you must actively use it, as non-use could lead to cancellation. Compliance with renewal deadlines is necessary to maintain continuous protection and ensure long-term market presence in the UAE.
