You have the right to return to the same job you were performing prior to maternity leave, as well as prior to any reduction in work hours/responsibilities that occurred due to the pregnancy. You also have the right to change the hours that you work and to request flexible working arrangements, including part-time, starting/finishing times and the option of working from home.
Employers have a legal obligation to give certain rights to mothers in the workplace with regards to maternity leave.
If you believe you have not been given these rights or have been unfairly dismissed because of discrimination, or on unreasonable grounds, you have 21 days from the date of dismissal to contact the Fair Work Commission and lodge a complaint.
