Question: How can I make sure that claims I make on my website are puffery rather than misleading?
Answer:Puffery usually refers to the wild descriptions or claims that are unlikely to ever to be thought of as true, for example, “we make the best sandwiches in the world!”
If you are unsure whether your statements are puffery or misleading, consider whether, as an ordinary consumer, you would take those statements to be true or not. Puffery is allowed, intentionally misleading or deceptive statements are not. Use your common sense when writing your slogans/marketing campaigns, and if you are still unsure a consumer lawyer can review your marketing content to ensure compliance with Australian Consumer Law.
