{"id":18822,"date":"2015-10-08T17:16:31","date_gmt":"2015-10-08T06:16:31","guid":{"rendered":"https:\/\/legalvision.com.au\/?post_type=legal-info&#038;p=18822"},"modified":"2023-09-21T16:16:07","modified_gmt":"2023-09-21T06:16:07","slug":"industrial-action","status":"publish","type":"page","link":"https:\/\/legalvision.com.au\/industrial-action\/","title":{"rendered":"Industrial Action"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">Industrial action is when:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">employees fail or refuse to perform work; or&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">an employer locks their employees out of their workplace.<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">It has the goal of settling a workplace dispute.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Industrial Action in Australia<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">Industrial action occurs when:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">employees fail or refuse to perform work; or&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">when an employer locks their employees out of their workplace.<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">It has the goal of settling a workplace dispute. This can be in the form of:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">strikes;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">stoppages;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">work bans; and&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">lock-outs.<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">It means action of any of the following kinds:<\/span><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>the performance of work by an employee in a manner different from that in which it is customarily performed. Or, the adoption of a practice in relation to work by an employee, the result of which is a restriction or limitation on, or a delay in, the performance of the work;<\/li>\n\n\n\n<li>a ban, limitation or restriction on the performance of work by an employee or on the acceptance of or offering for work by an employee;<\/li>\n\n\n\n<li>a failure or refusal by employees to attend for work or a failure or refusal to perform any work at all by employees who attend for work;<\/li>\n\n\n\n<li>the lockout of employees from their employment by the employer of the employees.<\/li>\n<\/ol>\n\n\n\n<h3 class=\"wp-block-heading infohub-head\">Why is Industrial Action Taken?<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Employees or employers can take industrial action for a variety of reasons. This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>to protest about the actions of others in the workplace;<\/li>\n\n\n\n<li>to negotiate workplace bargaining; and <\/li>\n\n\n\n<li>where there may be a threat to the health and safety of workers and stakeholders, including customers.<\/li>\n<\/ul>\n\n\n\n<div class=\"box box--info box--icon\">\n<p><span style=\"font-weight: 400\">A classic example is employees striking out the front of their place of employment to protest:<\/span><\/p>\n<ul>\n<li><span style=\"font-weight: 400\">poor working conditions;<\/span><\/li>\n<li><span style=\"font-weight: 400\">pay; or<\/span><\/li>\n<li><span style=\"font-weight: 400\">a decision made by management.<\/span><\/li>\n<\/ul>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading infohub-head\">Types of Protected Industrial Action<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Protected industrial action is action employees take for the purpose of supporting or advancing claims about an agreement under the Fair Work Act. Employees can only take protected action\u00a0 in support of bargaining for a proposed agreement.<\/p>\n\n\n\n<h3 class=\"wp-block-heading infohub-head\">Payments for Periods of Industrial Action<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Fair Work Act 2009 provides that during a period of industrial action it is unlawful for an:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>employer to pay an employee, and<\/li>\n\n\n\n<li>employee to receive payment from an employer.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In terms of protected and unprotected action:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>(a) Protected action:<br>(i) Strike\/stoppage. Not paid in respect of the period of action.<br>(ii) Partial work bans. The employer must decide in advance and notify employees \u2013 will it give full pay; no pay; part pay?<\/li>\n\n\n\n<li>(b) Unprotected action:<br>(i) Minimum reduction of four hours pay (or such longer period for which the employee is taking action).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Key Issues<\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The difference between protected and unprotected industrial action is important. Protected action provides protection from legal liability, such as receiving a fine or facing legal action.<\/li>\n\n\n\n<li>The Fair Work Commission (FWC) has the power to suspend or terminate protected industrial action.<\/li>\n\n\n\n<li>&#8220;Industrial action&#8221; can have an expanded view under the Fair Work Act. This can include distributing campaign information and wearing campaign uniforms.<\/li>\n\n\n\n<li>The action cannot relate to a proposed greenfields agreement or multi-enterprise agreement.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Protected Action<\/h2>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Industrial action will not be protected if taken before the nominal expiry of an enterprise agreement. Protected industrial action can only take place once the nominal expiry date of a Single Enterprise Agreement (SEA) has passed.<\/li>\n\n\n\n<li>The action must be about:\n<ol class=\"wp-block-list\">\n<li>matters about the employer\u2019s relationship with its employees or the employees\u2019 organisation (e.g.,. a union)<\/li>\n\n\n\n<li>payroll deductions or<\/li>\n\n\n\n<li>how the agreement will operate. <\/li>\n<\/ol>\n<\/li>\n\n\n\n<li>The action must be organised by the employees or their bargaining representative (e.g. the union).<\/li>\n\n\n\n<li>Before action is taken, the parties must have genuinely tried to reach an agreement. The law requires at least 50% of employees to vote, and the majority of these employees must authorise the industrial action for it to be protected. The vote is generally conducted by the <a href=\"http:\/\/www.aec.gov.au\/\">Australian Electoral Commission<\/a>.<\/li>\n\n\n\n<li>A majority of eligible employees must vote in support of the action through a secret ballot.<\/li>\n\n\n\n<li>The employer must receive at least three days\u2019 written notice of the industrial action before the employees take it.<\/li>\n<\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Adverse Action and Industrial Action<\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/legalvision.com.au\/adverse-action-in-the-workplace\/\"><span style=\"font-weight: 400\">Adverse action<\/span><\/a><span style=\"font-weight: 400\"> is any action tha<\/span>t <span style=\"font-weight: 400\">the Fair Work Act 2009 <\/span>prohibits<span style=\"font-weight: 400\"> due to it occurring for particular reasons, such as:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">discrimination; or&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">because an employee exercised a workplace right.&nbsp;<\/span><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400\">The Fair Work Act 2009 prohibits employers taking adverse action against an employee because they engaged in industrial action. If it is determined that an industrial activity was a \u2018substantial and operative factor\u2019 in the employer\u2019s reasons for taking an adverse action, then you will have contravened the Fair Work Act. <\/span><\/p>\n\n\n\n<div class=\"box box--info box--icon\">\n<p><span style=\"font-weight: 400\">In practice, this protects employees from being dismissed for going on strike with their union, for example.<\/span><\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Frequently Asked Questions about Industrial Action<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Q: Can unions stop negotiating with employers during the industrial action?<\/strong><br>A: No. Unions must genuinely try to reach an agreement with the employer at all times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Q: What is a go-slow action?<\/strong><br>A: A \u2018go slow\u2019 is where employees deliberately delay their work flow or reduces output to put pressure on the employer.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Q: Are lock-outs legal?<\/strong><br>A: A lockout may be &#8216;protected action&#8217; for the purposes of the Fair Work Act 2009 if it occurs during a bargaining period for an enterprise agreement, and the other appropriate procedures and conditions are adhered to.
